An odd situation. The guy sounds like an emotional weakling - if he really means it. Yeah, I know I’m being unsympathetic. Maybe more of his story will emerge.
He testified that he had woken up because the woman was performing oral sex on him. She at first denied it, but later changed her story, admitting sexual contact but claiming it was consensual.
The court said a legal amendment from 2000 defines such undesired sexual contact as rape.
The man said the episode left him with insomnia and virtually no interest in sex. He also described it as a breach of trust that had crushed his faith in people.

Theoretically possible but if she weren’t wearing a strap on how could it work without his body’s and probably his mind’s cooperation? She says he was smiling.
A 23-year-old woman has changed her story after biological evidence on a man’s underpants and penis demonstrated their physical contact. The woman no longer denies laying a finger on him but insists she has committed no crime.

Your body can do things entirely without your mind’s cooperation, even if you don’t want it to. It’s not at all unusual for a man being raped by another man to achieve erection and even ejaculation involuntarily; sometimes, the body can’t distinguish between sexual and nonsexual excitement, especially when sexual organs are being stimulated (or irritated, as the case may be).
And simply believing what a person accused of rape says — especially when their first statement, that there was no sexual contact, is disproved by evidence — would seem unwise in the extreme.

Just adding to note that I do realize that he wasn’t raped by another man but by a woman; however, the caveat that the body can react entirely inappropriately and against your wishes still applies.

Many years ago in jail I almost learned how my own body would react to being raped. Never talked faster in my life.
Was hardly the brightest thing I’ve ever put in a weblog.
And the only really relevant thing that can be said is any nonconsensual sex is wrong.

DUH! “This guy sounds like an emotional weakling”-yeah, right! If a woman woke up with some ugly-assed guy going down on her (whom she had previously rejected) this would be just another rape story. But because some GUY thought some ugly-assed skank was sucking his knob it’s NOT rape?!
Come on gals-you can’t have it both ways (pun intended).

WELL..I HAVE A STORY.. MY FRIEND HAD A AFFAIR WITH THIS WOMEN 12 YEARS AGO AND IT WAS JUST ABOUT SEX BECAUSE HE WAS MARRIED AND THE WOMEN KNEW IT AND IT WAS FINE WITH HER. I think a woman lying to a man so he will have sex with her, or unprotected sex, with her is rape.
that said, he should be partially financially responsible for the child because it takes two to tango, and the child is innocent and has to be cared for.
the woman should be charged with the crime of rape. There are two kinds of rape: forcible and non-forcible. If you trick someone into a sex act they did not consent to, you have had non-consensual, unforced, sex with them, and that is rape.
Fat chance that a woman would ever be charged under such circumstances, becasue we, as a society, treat women as weaker and lesser, and in sex that means a woman is presumed to be the victim in any dealings with a man.
There are instances where a man wore a condom, the woman saved the used condom, and impregnated herself against his wishes. The man still pays child support, and the woman doesn’t go to jail (in any case that I know of…do tell if you know different.)
In such a case the woman should go to jail, the man should have first shot at raising the child, and if not, the State should take the child. We wouldn’t leave a child with a male rapist.
